“Hi! I have 2 children, both elementary aged, and will not have childcare once “spring break” ends beginning of April. I’ve talked to my boss to try and avoid any last minute scheduling conflicts since schools are still going to be closed because of COVID. Well he told me he has to “let me go” when the time comes because he can’t accommodate me missing that much work. Is it legal for him to fire me for this? I need your help! Thanks”

Hi Amanda! To answer your question, an employer should refrain from terminating someone out on FMLA leave for caring for children out of school due to school closures and COVID-19 virus. However, most states in the US are at-will employment states, and employers can terminate if the COVID-19 or any other matter forces a business to reduce staff due to financial losses to the business.
